| Security: Amigo.Net actively
and automatically monitors all of our systems for attempts at
breaching our security, or attempts to access systems or resources
that are not available for customers to use or access. This is
commonly known as "hacking". Any attempt to access unauthorized
computer systems or to interfere with normal system operations,
whether on the equipment of Amigo.Net or any computer system or
network that is accessed by our services, will result in immediate
and permanent cancellation of your account and may also lead to
other legal proceedings against you.
Examples of inappropriate actions include, but are
not limited to:
- Satan or port scans
- Ping scans and Ping Floods
- SNMP attempts
- Mail host relay use or hi-jacking
- Telnet, FTP, Rcommands, etc. to internal systems
- Attempts to access privileged or private TCP or UDP ports
- HTTP access without the use of a Web browser
- Multiple and frequent Finger attempts
- Excessive resource utilization
- Source route spoofing
- Smurf attacks
- IP number spoofing or masquerading
- Syn Floods
- OOB attacks (WinNuke)
- Password cracking or guessing schemes
- Excessive email postings (see "Unlawful & Unacceptable
Usage," below)
Amigo.Net records the complete session of security
breach attempts such as those mentioned above, and may forward
this information on to the authorities during our investigations.
Amigo.Net takes security very seriously so that you and all of
our customers can enjoy a safe and productive Internet environment.
NONE OF THE ABOVE-MENTIONED SECURITY
PROBLEMS ARE EVER ACCIDENTAL, AND NORMAL USE OF INTERNET SOFTWARE
SUCH AS BROWSERS AND EMAIL PROGRAMS WILL NEVER CAUSE A PROBLEM.
ALL OF THE ABOVE ACTIONS ARE DELIBERATE AND INTENTIONAL AND IN
MANY CASES REQUIRE SOPHISTICATED PROGRAMS AND KNOWLEDGE. PARENTS
ARE RESPONSIBLE FOR CHILDREN WHO MAY USE THEIR ACCOUNT TO PERFORM
ANY OF THE ABOVE ILLICIT ACTIVITIES.
Unlawful & Unacceptable Usage:
Amigo.Net's network of information services may only
be used for lawful purposes. Transmission of any material in violation
of any federal or state regulation is prohibited. This includes
copyrighted material, material judged to be threatening or obscene,
or material protected by trade secret.
It is contrary to this Acceptable Use Policy for any user to effect
or participate in any of the following activities through an Amigo.Net
provided service:
To post ten (10) or more messages similar in content
to Usenet or other newsgroups, forums, e-mail mailing lists or
other similar groups or lists;
To post to any Usenet or other newsgroup, forum,
e-mail mailing list or other similar group or list articles which
are off-topic according to the charter or other owner-published
FAQ or description of the group or list;
To send unsolicited e-mailings to more than twenty-five
(25) e-mail users, such as chain-letters.
To send ANY unsolicited e-mailing if such could reasonably
be considered SPAM or otherwise provoke complaints (such as solicitations
for participation in multilevel marketing or pyramid schemes,
marketing blasts, etc.).
To falsify user information provided to Amigo.Net
to other users of the service.
To post on the Internet any material that: exploits
children under 18 years of age, contains nudity or pornographic
material of any kind, promotes information about illegal or harmful
activities, defames any person or group, promotes or solicits
participation in multilevel marketing or pyramid schemes, or otherwise
may be construed as harassing, illegal, or unlawful.
Privacy:
While every attempt is made to keep all information
passing to and from our systems, and to and from our customers
private, you must assume that any information that you transmit
or receive may not be private. Amigo.Net will fully cooperate
with any authority in investigation of illegal activity and may
turn over logs and records upon receipt of proper orders. The
Electronic Communications Act of 1986 and the Telecommunications
Act of 1998 contains important privacy and confidentiality information.
Selling of Customer information:
Amigo.Net does not and will not sell or transfer
any information about our customer base to any third party for
the purpose of using that information for marketing or direct
sales.
General:
In all cases, Amigo.Net reserves the right
to disconnect any customer connection that is using excessive
resources of the Amigo.Net network. Amigo.Net's security and abuse
department will work with all customers to help ensure that proper
procedures are employed that limit the possibility of resource
abuse. Nothing contained in this policy shall be construed to
limit Amigo.Net's actions or remedies in any way. Amigo.Net reserves
the right to take any and all additional actions it may deem appropriate
with respect to such activities, including without limitation
taking action to recover the costs and expenses of identifying
offenders and removing them from the Amigo.Net service, and levying
cancellation charges to cover Amigo.Net's costs in the event of
disconnection of dedicated access for the causes outlined above.
In addition, Amigo.Net reserves at all times all rights and remedies
available to it with respect to such activities at law or in equity.
